Remote communication technique: a method used without both parties being physically present

Article 3 – Applicability

These terms apply to every offer and every distance contract between entrepreneur and consumer. The terms must be made available before the contract is concluded.

If provisions are invalid, the rest of the agreement remains valid, and unclear provisions must be interpreted in line with the spirit of these terms.

Article 4 – The Offer
Offers may have limited validity or conditions
Offers are non-binding and may be changed
Product descriptions must be accurate
Images are indicative and may differ slightly
Errors do not bind the entrepreneur

The offer must clearly state:

Price (excluding import duties and VAT)
Shipping costs
Payment and delivery terms
Right of withdrawal
Duration and validity of the offer
Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and meets conditions.

Electronic acceptance is confirmed electronically
Secure payment and data protection are ensured
Orders may be refused with justification
Key information must be provided with the product
Article 6 – Right of Withdrawal

Consumers may cancel within 14 days without giving a reason.

The period starts the day after receiving the product
Products must be returned in original condition
Consumers must notify withdrawal within 14 days
Return must also occur within 14 days
Article 7 – Costs in Case of Withdrawal
Return shipping costs are paid by the consumer
Refunds are issued within 14 days after return
Article 8 – Exclusion of Withdrawal

Withdrawal may be excluded for:

Custom-made or personalized products
Perishable goods
Sealed items (e.g., hygiene, software, media) once opened
Services started with consent
Article 9 – Price
Prices remain stable during offer validity
Changes allowed due to VAT or legal changes
Import VAT and customs fees may apply
Printing errors are not binding
Article 10 – Conformity and Warranty
Products must meet expectations and legal requirements
Complaints must be reported within 14 days
Warranty excludes misuse or improper handling
Article 11 – Delivery and Execution
Orders are delivered within 30 days unless agreed otherwise
Delays give the right to cancel
Refunds follow within 14 days after cancellation
Risk transfers upon delivery

Consumers may:

Cancel indefinite contracts anytime (max 1 month notice)
Cancel fixed-term contracts at the end

Automatic renewal rules apply with limits.

Payment must be made within 7 working days
Errors in payment details must be reported
Late payment may incur costs
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days
Responses within 14 days
Valid complaints lead to repair or replacement
Article 15 – Disputes

All agreements are governed by Dutch law, even for foreign customers.
